Terms of Service

By accessing or using the Postivex platform at https://postivex.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. If you are using Postivex on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Postivex is an AI-powered social media management platform that provides:

• AI-powered social media profile auditing and optimization
• AI content generation for LinkedIn, Facebook, and Reddit
• Post scheduling and publishing on connected social platforms
• Lead detection and CRM functionality
• Analytics and performance tracking
• AI-generated image creation
• Advertising copy assistance

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

To use Postivex, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized account access at support@postivex.com
• Not share your account with others
• Be responsible for all activity that occurs under your account

You must be at least 16 years old (or the minimum age required in your jurisdiction) to create an account.

Subscription Plans: Postivex offers free and paid subscription tiers. Paid plans are billed in advance on a monthly or annual basis.

Free Trial: When offered, free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled.

Payment Processing: Payments are processed by our third-party payment processors (Paddle, LemonSqueezy, SSLCommerz, or PayPal). By subscribing, you authorize your chosen processor to charge your payment method on a recurring basis.

Refunds: Refund requests are handled on a case-by-case basis. Paid subscriptions are generally non-refundable, except where required by applicable law (e.g., EU consumer protection law — 14-day right of withdrawal for distance contracts, unless you have already used the service).

Price Changes: We may change subscription prices with 30 days' advance notice. Continuing to use the Service after the effective date constitutes acceptance of the new price.

Taxes: Prices are exclusive of VAT, GST, or other applicable taxes. These will be calculated and added at checkout based on your location.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the subscription period ends.

To delete your account, go to Settings → Account → Delete Account. This action permanently deletes all your data and cannot be undone.

You agree not to use Postivex to:

• Violate any applicable laws or regulations
• Infringe intellectual property rights of any party
• Generate, publish, or distribute spam, misinformation, or deceptive content
• Harass, abuse, threaten, or harm any individual or group
• Generate content that is defamatory, obscene, or violates third-party rights
• Attempt to gain unauthorized access to Postivex systems or other users' accounts
• Use automated scripts or bots to scrape or misuse the platform
• Violate the Terms of Service of LinkedIn, Facebook, Reddit, or any connected platform
• Impersonate any person, organization, or entity
• Use the Service for any illegal purpose, including unauthorized data collection

Violation of this policy may result in immediate account suspension without refund.

Ownership: You retain ownership of content you create, upload, or publish through Postivex.

License to Postivex: By using the Service, you grant Postivex a limited, non-exclusive license to process, store, and transmit your content solely as necessary to provide the Service.

AI-Generated Content: Content generated by AI on your behalf through Postivex belongs to you, subject to any applicable law regarding AI-generated works. You are responsible for reviewing and approving AI-generated content before publishing.

No Training: We do not use your content to train AI models. Your data is processed only to deliver the Service to you.

Responsibility: You are solely responsible for the content you publish via Postivex, including compliance with applicable laws and third-party platform policies.

Postivex integrates with third-party platforms (LinkedIn, Facebook, Reddit) via their official APIs. Your use of these integrations is also subject to those platforms' terms of service:

• LinkedIn User Agreement
• Facebook Terms of Service
• Reddit User Agreement

We are not responsible for changes to these platforms' APIs or policies that may affect Postivex functionality. No refunds are provided if platform API restrictions limit our Service.

The Postivex platform, including its software, design, branding, and proprietary technology, is owned by Postivex Ltd. and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

The Postivex name, logo, and trademarks are property of Postivex Ltd.. You may not use them without written authorization.

To the maximum extent permitted by applicable law:

• Postivex is provided "as is" without warranty of any kind, express or implied
• We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you shall not exceed the amount paid by you in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

For EU/UK consumers: These limitations do not affect your statutory rights under applicable consumer protection laws.

You agree to indemnify and hold harmless Postivex Ltd., its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service in violation of these Terms
• Content you create, publish, or distribute through the Service
• Your violation of any third-party rights

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms. Upon termination:

• Your right to access the Service ceases immediately
• We may delete your account data (subject to our data retention policy)
• Provisions of these Terms that by nature should survive termination will continue to apply (including liability limitations, intellectual property, and dispute resolution)

You may terminate your account at any time. See Section 5 for cancellation details.

Governing Law: These Terms are governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of the jurisdiction in which Postivex Ltd. is registered.

For EU/EEA users: You may benefit from mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under EU consumer protection law, including the right to use alternative dispute resolution (ADR) mechanisms. The European Commission provides an online platform for dispute resolution at ec.europa.eu/consumers/odr.

For US users: Disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, except where prohibited by law. Class action waivers apply to the extent permitted.

Contact first: Before pursuing formal dispute resolution, please contact us at legal@postivex.com — we aim to resolve issues within 30 days.

We may revise these Terms at any time. For material changes, we will provide at least 30 days' notice via email or a prominent in-app notice. If you do not agree with the changes, you must stop using the Service before the effective date.

Continued use of the Service after the effective date of revised Terms constitutes your acceptance.

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Postivex.
• Severability: If any provision is found invalid, the remaining provisions remain in full force.
• No Waiver: Failure to enforce any provision does not constitute a waiver.
• Assignment: You may not assign your rights or obligations under these Terms. We may assign ours in connection with a merger or acquisition.
• Language: These Terms are written in English. In case of translations, the English version prevails.
